As a trusted advisor, Mat is an experienced intellectual property lawyer whose practice is focused on intellectual property disputes and multi-jurisdictional litigation. He has represented well-known international brands, leading technology companies, and major public institutions.
Mat builds and defends intellectual property rights in trademarks, copyrights, software, patents and designs. He also advises businesses regarding the use of IP assets online, navigating unique challenges with novel use, software and app copyright matters, streaming, and other emerging platform issues.
On behalf of his clients, Mat obtains and enforces pre-judgment remedies, including injunctive relief, asset freezing orders, civil search warrants, and discovery and disclosure orders.
Mat has particular expertise in multi-jurisdictional litigation and has acted on behalf of clients obtaining evidence in Canada for use in legal proceedings around the world, and clients concurrently enforcing their intellectual property rights in multiple jurisdictions.
In contentious proceedings, Mat acts across a variety of forums, including the Federal Courts, the British Columbia, Alberta, and Ontario Courts, arbitrations, and before the Trademarks Opposition Board. Prior to practicing, Mat clerked for the Supreme Court of Canada with Justice Rothstein and for the B.C. Court of Appeal with Justices Newbury and Mackenzie

- Acted for Farmobile Canada in litigation against Farmer’s Edge regarding the infringement and validity of patents for integrated hardware-software technology for the agricultural sector.
- Acted for NCS Multistage in litigation against Kobold Industries regarding infringement and validity of patents for downhole tools and processes in the energy sector.
- Acted for Garfinkel Publications dba Native Northwest in copyright infringement proceedings to halt ongoing infringement of the artwork of Dr. Francis Horne Sr., an acclaimed Coast Salish artist.
- Acted for Secure Energy Services in proceedings confirming Secure’s ownership of a patent related to drilling fluids in the energy sector.
- Counsel in private arbitration proceedings surrounding a multi-million dollar contract for the customization and implementation of SaaS software designed for Enterprise Resource Planning (ERP).
- Counsel for the plaintiff at trial and on appeal (Vancouver Community College v. Vancouver Career College (Burnaby) Inc., 2017 BCCA 41), successfully obtaining an order for damages and permanent injunction prohibiting defendant from using trademarks online as a domain name or otherwise regarding its Internet presence
- Represented RE/MAX in trademark proceedings (RE/MAX v. Save Max, 2019 FC 1582), including obtaining an order for disclosure of a solicitor’s file.
- Represented Biofert (Biofert Manufacturing Inc. v. Agrisol Manufacturing Inc., 2020 FC 501) a leading manufacturer of fertilizers through to trial against Defendants found liable for trademark infringement and passing off, as a result of their launch of an unauthorized competitor intended to divert sales by harnessing historical goodwill.
- Represented Blackberry regarding claims surrounding the allegedly faulty development of video conferencing software, successfully resolved shortly before trial.
- For Louis Vuitton, successfully obtained and defended an Anton Piller order and Mareva injunction preserving evidence of the defendants’ counterfeiting activities and securing assets for judgment, and subsequently obtaining judgment against Defendants at summary trial for a variety of unlawful activities related to the sale of counterfeit goods.
- For Chanel (Annie Pui Kwan Lam v. Chanel S. de R.L et al. 2016 FCA 111), confirming personal liability of an individual, and determinations of credibility upon summary trial.
- For the Council of Natural Medicine College of Canada v College of Traditional Chinese Medicine Practitioners and Acupuncturists of British Columbia, 2013 FC 287, successfully defended a challenge to the constitutionality of the official marks regime under s. 9 of the Trade-marks Act, upholding the college’s right to protect certain professional designations as official marks
- Counsel for Cascade Aerospace (Cascade Aerospace Inc. V. AGNL Avionics Abbotsford Nominee ULC), obtaining a novel injunction to halt the continued distribution of confidential information, including by parties in knowing receipt.
